Storage
When Storing any type of boat, toy or vessel with Blue Lagoon Marine, you agree to the following. If ignored it could result in your boat being removed from the premises.
- They comply with the below terms otherwise Blue Lagoon – Private boat storage has the right to sell, relocate or remove the owners property from the private land.
- That Blue Lagoon – Private Boat Storage is in no manner liable or responsible for the loss or damage to boats or equipment however so caused, and the boats on the premises are at the sole risk of the owner.
- Acknowledges and agree that Blue Lagoon – Private Boat Storage, shall not have any liability for the loss or damage to the property whatsoever however caused arising out of the storage of any boat and that any boat is stored at the owners risk. The owner indemnifies Blue Lagoon – Private Boat Storage from all claims and liabilities arising from the storage of any boat by the owner.
- Insurance is the sole responsibility of the owner.
- Allocation of a designated storage space is at the sole discretion of Blue Lagoon – Private Boat Storage and Blue Lagoon – Private Boat Storage is at its absolute discretion may allocate an alternate space at any time during the season.
- That Blue Lagoon – Private Boat Storage, in its sole discretion, may terminate this agreement by written or email notice to the owner at his/her last notified address at any time for such reasons as Blue Lagoon – Private Boat Storage may determine, including but not limited to the following:
- The storage fees remain unpaid for 1 months after the due date;
- The owner fails to comply with the agreed terms
- The owner shall remove the boat and its associated equipment from Blue Lagoon – Private Boat Storage within 14 days of the notice of termination.
- If Blue Lagoon – Private Boat Storage has terminated the associated agreement by notice in writing or email to the owner and the owner does not remove the boat including the associated equipment from the premises within 28 days of the notice termination, the owner authorizes Blue Lagoon – Private Boat Storage as his or her agent to sell or otherwise dispose of the boat and associated equipment without notice to the owner and recover from any proceeds all costs associated with the removal, storage, sale or disposal of the boat and equipment (“costs”). Any proceeds of the sale remaining after the deduction of the costs and monies owing to by the owner to Blue Lagoon – Private Boat Storage, shall be remitted to the owner at the owner’s last known address. Blue Lagoon – Private Boat Storage may sell the boat and associated equipment pursuant to this provision in any way it deems appropriate, whether by private sale or public auction.
- Owners undertake to stow boats, stands, trolleys and all equipment in a tidy manner in the allocated space and to assist in keeping the storage area tidy and clean at all times.
- The owner must provide their on safety equipment including trailer clamps and locks.
- Owners must have and provide a copy of their personal insurance.
- The owner may employ outside help to do work on the boat while in storage after seeking full agreement from Blue Lagoon – Private Boat Storage, when work is being done by the owners or by the volunteer or employed outside help, such work must be conducted in such a manner that will not hinder the work of others, cause disruption to the surrounding neighbours, create a hazard, cause damage that may result from their failure or the failure of their volunteer or employed workers to observe the conditions of this agreement.
- Owners are responsible for clean up of all scraping, sanding, and grinding of bottoms, topsides, brightwork, etc., in a manner that all removed material is to be collected and disposed of in appropriate trash containers. Drop cloths, tenting, and dustless sanding systems will be required to con- fine all materials for removal and disposal. Any and all methods used by Owners will be subject to inspection and approval by Blue Lagoon – Private Boat Storage,
- Owners will be charged if clean up is not done to the satisfaction of Blue Lagoon – Private Boat Storage.
- Blue Lagoon – Private Boat Storage has the right to change these terms at any point during the season.
Key Boat Storage Conditions
- Keep boat storage area clear and tidy, and use the allocated area
- See permission from Blue Lagoon – Private Boat Storage before commencing any work.
- The owner acknowledges they have read the boat storage agreement.
- The owner has a responsibility to pay storage fees when they are due.
Brokerage
Blue Lagoon Marine provides the details of all brokerage boats in good faith but cannot guarantee the accuracy of the information provided by the owners of the vessels. These details are provided as a guide only and do not constitute a term of any contract. A potential buyer is advised to check the details and specifications of the vessel and where necessary instruct any agents or surveyors to fully inspect the vessel and/or to have a sea trial of the vessel. This vessel is offered subject to prior sale, price change, or withdrawal without notice.
